Family safety, separation and children

Separate immediate protection, divorce paperwork and decisions about children so each reaches the right authority.

General information for mainland Shenzhen. These are illustrative examples, not reported judgments or personal legal advice. Hong Kong and Macao have separate systems.

01

Violence or threats at home

A family or household member is violent, threatening, stalking or controlling your ability to leave safely.

What to do first

  1. If danger is immediate, reach a safer place if possible and contact 110; use 120 for a medical emergency. Do not delay for documents.
  2. Tell police about the violence, injuries and any child at risk. Ask about medical assistance and safe temporary support.
  3. Ask the competent basic people’s court about a personal-safety protection order; a divorce case is not a prerequisite.
Where to take it

Emergency police/medical help first; a competent court can consider protection. Ask authorities about safe shelter and lawful legal assistance where needed.

A mistake to avoid

Do not confront the abusive person or return to danger to obtain recordings, belongings or “better proof”.

Get help promptly when…

Violence, credible threats, stalking or confinement is happening now, or a child/dependent person is unsafe.

Records to keep3 useful records
  • Police reports, warning letters or receipts already held
  • Existing medical notes and safely held threatening messages
  • A factual account and existing support/witness records

Use records already safely and lawfully available. Do not delay urgent help or expose yourself or a child to danger to collect documents.

02

Separation or divorce: which documents and route?

You are considering separation or divorce, possibly with a foreign nationality, overseas marriage or assets in more than one place.

What to do first

  1. Record where the marriage was registered and each spouse’s nationality/residence; confirm registry eligibility or court jurisdiction before preparing a filing.
  2. Gather identity/marriage records and child/financial documents you can lawfully access. Ask what translations or authentication the receiving authority needs.
  3. For the consensual registry route, prepare written terms on children, property and debts; confirm its stages and dates with the competent office.
Where to take it

A competent marriage registry handles eligible consensual registrations; disputed cases or marriages outside its scope require jurisdiction advice about the court route.

A mistake to avoid

Do not treat a signed private separation agreement as proof that the marriage has legally ended.

Get help promptly when…

There is violence, a child is at risk, assets may be hidden, or you receive court papers or a time-sensitive official notice.

Records to keep3 useful records
  • Identity documents, marriage certificate and available marriage archives
  • Existing child-care arrangements, birth records and court documents
  • Lawfully held asset, debt, income and housing documents

Use records already safely and lawfully available. Do not delay urgent help or expose yourself or a child to danger to collect documents.

Official sources and legal basis
  • Civil Code: marriage and children ↗

Arts 1058 (parents’ equal rights/duties), 1076–1080 (agreement/registry and court routes; when marriage ends), 1084–1086 (child care, support and contact). Effective 1 January 2021.

  • Marriage registration work rules: divorce documents ↗

03

A child may be at risk or taken across a border

A child may be harmed, concealed or moved to another jurisdiction during a family dispute, or you are considering a relocation.

What to do first

  1. For immediate harm or a missing child, contact 110 and give the child’s known location or last whereabouts. Safety comes before gathering paperwork.
  2. Keep safely available identity/birth copies, existing orders and known travel details; share the risk with the handling authorities.
  3. Before a non-urgent cross-border move, obtain advice on parental authority, existing orders and each jurisdiction’s rules; assess urgent court protection if needed.
Where to take it

Police/child-protection authorities address safety. Courts may consider protection/injunctions or temporary care in qualifying concealment/separation disputes; overseas recognition needs separate assessment.

A mistake to avoid

Do not assume that possessing a passport or visa settles permission for a disputed relocation.

Get help promptly when…

The child is missing, being harmed or threatened, or an intended departure or concealment is imminent.

Records to keep3 useful records
  • Existing birth/identity records and custody/contact orders
  • Known itinerary, last whereabouts and relevant messages already held
  • Existing police, school or medical records relevant to the risk

Use records already safely and lawfully available. Do not delay urgent help or expose yourself or a child to danger to collect documents.
