Safety, possession and deadlines come first

If you are in immediate danger or facing a forced lockout, call police on 110. For urgent medical help call 120.

Immediate danger or forced lockout

Prioritise safety. Seek police or medical help as needed.

Official notice or deadline

Keep the notice, envelope and delivery proof. An enquiry may not preserve a deadline.

Access to the home

Distinguish lawful entry, repair access, harassment and possession disputes.

Large payment or transfer

Pause if title, authority, restrictions or the payment route are unclear.

Rental deposit recovery

A practical workflow when a deposit is disputed. Recovery is not guaranteed.

  1. 1Gather the record

Keep the lease, amendments, deposit receipt, payment ledger and original correspondence.

  2. 2Read the agreed terms

Identify the agreed return date and deduction grounds; there is no universal refund-day rule here.

  3. 3Compare condition

Use move-in/out photos and inventory. Proper-use wear and tenant-caused damage are different.

  4. 4Itemise the dispute

Ask for each proposed deduction, its basis and supporting evidence; show your calculation separately.

  5. 5Confirm handover

Record keys, inspection, meter readings, final charges and the refund request; retain delivery evidence.

  6. 6Choose the correct route

If negotiation fails, check mediation, valid arbitration arrangements or the competent court. A complaint alone does not guarantee repayment.

Lease filing and lease validity are not the same thing

Contract validity (民事效力)

Civil Code 706 says failure to complete required lease registration/filing does not itself affect the contract’s validity. That does not remove filing duties or resolve other validity defects. Under rental-regulation 8, the tenant may file if the lessor has not; the current Shenzhen online route has its own scope and identity requirements.

Filing / registration (备案/登记)

Check the current Shenzhen filing route, applicant, documents and purpose. Filing does not replace a title or authority check.

Who can rent the property — and on what terms?

Key duties under the national housing rental regulation within its scope.

Safe, lawful housing

The national regulation covers housing rentals on urban state-owned land. Safety standards apply; kitchens, bathrooms, balconies, corridors, basement storage and garages cannot be let separately for living.

Authority before commitment

The lessor must show identity and title or other lawful letting authority. For a sublet, verify consent and the underlying term; obtain written evidence rather than relying on assurances.

Deposit terms must be stated

Agree the amount, return timing and deduction circumstances. Outside the agreed circumstances, the lessor must not deduct without legitimate reason. Do not assume a universal cap or return period.

Filing and validity differ

Non-filing alone does not invalidate a lease. Filing duties remain; the tenant may file if the lessor has not. Official contract filing is free under the regulation.

Repairs depend on duties and cause

The lessor generally repairs unless otherwise agreed; tenant-caused faults are treated differently. Request necessary repairs and check the conditions before self-repair or rent adjustment.

Access and move-out have limits

No unauthorised landlord entry, except consent or lawful grounds; tenants must cooperate with lawful necessary access. Lawful termination requires notice and reasonable move-out time, not violence, threats or illegal pressure.

Entry, necessary repairs and possession disputes

Rental-regulation 9 prohibits unauthorised entry by the lessor except with tenant consent or lawful grounds; 11 requires cooperation with lawful necessary entry. Article 12 prohibits violence, threats or other illegal pressure to force termination or move-out. Property managers cannot cut utilities to collect management fees under Civil Code 944. These rules do not authorise physical confrontation, a unilateral rent strike or assumptions about every emergency.

6

Agency and platform checks

Check the housing rental broker or platform before signing or paying.

Identify the agency and staff

Verify the business and agent’s agency relationship; rental-broker staff must not take brokerage business in their personal name.

Get the service contract

Check the written brokerage agreement, agency stamp, services and responsibility—not just a chat promise.

Check the actual property

The broker must check identity and title information, inspect the property and prepare a stamped condition statement.

Match the listing to reality

Rental information must be truthful, accurate and complete; photographs should match the offered property.

Itemise all agency charges

Rental brokers must display service prices and cannot add unlisted charges. Keep the agreed fee terms and receipt.

Separate fees from rent and deposit

Housing-rental brokers and listing platforms must not collect or pay rent or deposits. This differs from charging an agreed brokerage fee or being the actual lessor.

Check signing authority

A broker cannot sign a housing lease in a party’s name without that party’s consent. Verify the authority rather than assuming it.

Confirm who files the lease

Where a housing lease is concluded through a rental broker, the regulation assigns contract filing to that broker. Keep the result.

  1. Keep the lease, amendments, payment receipt and dated move-in/out records.
  2. Identify the agreed return date, deduction grounds and any unpaid rent or utilities.
  3. Compare the inventory and condition records; proper-use wear differs from tenant-caused damage.
  4. Request an itemised written explanation and evidence for disputed deductions.
  5. Send a clear written return request; retain delivery evidence and any reply.
  6. If unresolved, check mediation, an applicable arbitration agreement or the competent civil court.
Can this person let or sell it?First steps, records and the appropriate route
  1. Identify the exact unit and the person or company signing.
  2. Ask for identity and title or other lawful letting-authority documents.
  3. If a representative signs, verify the appointment, scope, duration and identity.
  4. For a sublet, check the original lease, remaining term and evidence of lessor consent.
  5. Use the official register-query route for information you are entitled to obtain.
  6. Resolve mismatched names, missing authority or unexplained payees before committing money.
Repairs, leaks or an unsafe homeFirst steps, records and the appropriate route
  1. Leave immediate danger where possible; use 110 for police danger or 120 for urgent medical help.
  2. Preserve dated photos, inspection reports and a record of how use is affected.
  3. Notify the landlord and relevant manager in writing; keep delivery and repair replies.
  4. Check the lease’s repair allocation and whether tenant fault caused the problem.
  5. Arrange lawful access; obtain advice before self-repair, rent deductions or ending the lease.
  6. Keep reasonable repair quotations, invoices and records for the appropriate claim.
Property-management or neighbour disputeFirst steps, records and the appropriate route
  1. Identify whether the problem involves your unit, shared facilities, a neighbour or a service duty.
  2. Keep dated incident, inspection, repair and correspondence records.
  3. Notify the relevant manager or neighbour; tenants should also notify their landlord.
  4. Ask for the relevant service terms, fee basis and response plan.
  5. Seek housing-channel guidance or mediation; management does not itself decide civil compensation.
  6. Get advice before withholding fees or taking action against someone else’s property.
Lease filing or registration is unclearFirst steps, records and the appropriate route
  1. Distinguish lease filing from title registration and other administrative formalities.
  2. Ask who will file and keep the filing receipt or result.
  3. Under the national rental regulation, a tenant may file if the lessor has not.
  4. Use the current official Shenzhen instructions; online eligibility and document requirements vary by route.
  5. If an agency arranged the housing lease, check its filing obligation.
  6. Do not treat a missing filing record as proof that all rent or deposit obligations disappear.
I am considering a purchaseFirst steps, records and the appropriate route
  1. Confirm the exact property, registered rights, intended use and seller’s authority.
  2. Obtain lawful register information on relevant mortgages, seizures or other recorded restrictions.
  3. Check current buyer eligibility and the transaction-specific official registration checklist.
  4. Review payment safeguards, finance approval, taxes, conditions and default consequences before signing.
  5. Plan the mortgage release or transfer, handover and registration sequence with qualified advisers.
  6. Do not assume payment, keys or a contract alone completes registered ownership transfer.
Foreign buyer or overseas paperworkFirst steps, records and the appropriate route
  1. Confirm how your nationality, residence status and proposed property affect the current rules.
  2. Ask the registration authority for the current transaction and identity-document requirements.
  3. Verify lending, payment and foreign-exchange requirements separately before transferring funds.
  4. For an overseas power of attorney, check wording, powers, validity and the receiving authority’s requirements.
  5. Check the applicable notarisation, translation, apostille or consular-authentication route for that document.
  6. Get case-specific advice; neither a generic one-year rule nor this page confirms your eligibility.

Foreign-buyer rules depend on the person, property, current national and local policies, and the actual transaction. Do not rely on a blanket one-year rule or assume that a residence/work document guarantees purchase eligibility. Confirm eligibility with the competent housing/registration authority and separately confirm lending, tax, payment and foreign-exchange requirements before committing funds.

I am not sure where to startFirst steps, records and the appropriate route
  1. Address immediate danger first; do not delay urgent help to organise documents.
  2. Identify the contract, parties, property and exact decision or request received.
  3. Keep originals, payment records, delivery dates and a private chronology.
  4. Use the twelve checks as your own evidence tags, not a legal approval score.
  5. Call 12348 for legal-service guidance or 0755-12368 for Shenzhen court procedures.
  6. Have jurisdiction, any arbitration agreement and document-specific deadlines checked promptly.
Questions worth askingDocuments, deadlines and a qualified consultation

Contract notice periods, civil limitation, court response/appeal deadlines and preservation procedures are different. Their start, interruption, suspension and exceptions need individual review. Do not assume that a complaint, informal negotiation or a reply still awaited stops every relevant clock; get document-specific advice promptly.

  • Who is the registered right holder, and who has authority to act?
  • What precisely does the contract say about return, deductions and termination?
  • What proves the condition, balance, handover and date of delivery?
  • Which official registration information am I entitled to request?
  • Which dispute route applies, and what deadline must I preserve?
